Bill Summary: SB348

• Creates the "Preemption of Class I Groundwater Aquifer Designations Without Adequate Review, Implementation and Interagency Impact Analysis" act to regulate groundwater classification procedures.

• Prohibits the Oklahoma Water Resources Board from adopting Class I Groundwater Aquifer designations without first holding a formal, public interagency working group meeting under the Oklahoma Open Meetings Act and Oklahoma Open Records Act.

• Requires the interagency working group to evaluate potential impacts of aquifer designations on other Water Quality Standards and rules administered by the Board, Department of Environmental Quality, Department of Mines, Corporation Commission, Department of Agriculture, Food and Forestry, and other state environmental agencies.

• Mandates the Board develop specific criteria, procedures, and requirements for Class I aquifer designations under Oklahoma Administrative Code through the Administrative Procedures Act to allow interested parties adequate opportunity to comment on predetermined requirements before adoption.

• Declares an emergency clause making the act effective immediately upon passage and approval.
