SB 389 Summary

• Amends 11 O.S. 2011, Section 22-111 regarding municipal authority to clean property and cut/mow weeds and grass within city limits.

• Reduces the height threshold for vegetation considered a "weed" from twelve (12) inches to eight (8) inches, making it easier for municipalities to take action on overgrown properties.

• Expands municipal authority to summarily abate nuisances on property within six months of initial notice without further prior notice to property owners.

• Maintains exemptions for agricultural property over ten acres and railroad property under Oklahoma Corporation Commission jurisdiction, but allows municipalities to remove weeds/trash from agricultural property if they pose a traffic hazard within ten yards of public rights-of-way.

• Becomes effective July 1, 2013 and is declared an emergency measure.
