SB 433 Summary

• Amends 76 O.S. 2011, Section 5 to make the Good Samaritan Act's language gender-neutral by replacing male pronouns with "he or she" and "his or her" throughout the statute.

• Extends liability protections to persons administering an opioid antagonist to someone experiencing an opioid overdose, protecting them from civil liability when acting in good faith without compensation.

• Maintains existing protections for medical professionals and laypeople providing emergency care (CPR, wound treatment, emergency surgery) without compensation, protecting them from liability except for gross negligence or willful/wanton conduct.

• Establishes that Good Samaritans who provide emergency assistance are not liable for civil damages resulting from their emergency care actions or omissions, with limited exceptions for gross negligence.

• Effective date set for November 1, 2013.
