SB 461 Summary

• Amends the Public Competitive Bidding Act of 1974 and Oklahoma Central Purchasing Act to regulate purchasing cooperatives in public construction contracts.

• Prohibits public agencies from awarding construction contracts exceeding $50,000 to contractors affiliated with purchasing cooperatives unless the cooperative complied with competitive bidding requirements including sealed bids.

• Prohibits purchasing cooperatives and affiliated contractors from bidding on public construction contracts exceeding $50,000 unless the cooperative complied with open competitive sealed bidding procedures.

• Requires purchasing cooperatives and affiliated contractors to comply with competitive bidding procedures for contracts between $2,500 and $50,000, including submission of written bids.

• Effective November 1, 2013.
