SB 533 Summary

• Changes mandatory language for sanctions in frivolous lawsuits from "may impose" to "shall impose" in 12 O.S. 2011, Section 2011.1

• Requires courts to impose sanctions authorized by Section 2011 when a claim or defense is found to be frivolous (knowingly asserted in bad faith or without rational legal/factual basis)

• Maintains existing requirement that courts reimburse prevailing parties for reasonable costs and attorney fees related to frivolous claims or defenses

• Effective date of November 1, 2013
