SB 536 Summary

• Amends 40 O.S. 2011, Section 61 to allow public schools to disclose information about a current or former employee's job performance to another public school that is a prospective employer, without employee consent.

• Previously, only state agencies could make such disclosures without consent; this bill extends the same authority to public schools as defined in Section 1-106 of Title 70.

• Employers disclosing job performance information are presumed to be acting in good faith and have immunity from civil liability unless the disclosed information is proven false and the employer had knowledge of falsity or acted with malice or reckless disregard for the truth.

• Effective July 1, 2013, with emergency clause making it effective upon passage and approval by the Governor.
