Unfair Sales Act Amendments (S.B. 550)

• Amends Oklahoma's Unfair Sales Act (15 O.S. 2011, Sections 598.1-598.7) to update language and modernize references throughout the statute.

• Adds new exemption allowing retailers and wholesalers to sell specific items below cost for 15 or fewer consecutive days, up to 10 separate times per 12-month period, excluding restricted categories like gasoline, legend drugs, and food items.

• Restricts the below-cost exemption from applying to gasoline, diesel fuel, legend drugs, food and nonalcoholic beverages, household soaps and detergents, health and beauty aids, over-the-counter medicines and vitamins, pet food and supplies, paper and plastic goods, cleaning supplies, baby supplies, low-point beer, and structural building materials.

• Maintains existing protections against unfair competition by preserving penalties for violations and allowing injured parties to seek injunctive relief and damages.

• Effective date: November 1, 2013.
