SB 578 Summary

• Creates the Oklahoma Department of Health Civil Monetary Penalty Revolving Fund as a continuing fund not subject to fiscal year limitations in the State Treasury.

• Fund receives monies from fines and assessments against Oklahoma nursing homes and other long-term and non-long-term care facilities found non-compliant with federal conditions of participation.

• Commissioner of Health may expend funds at discretion for protecting the health or property of residents in nursing facilities, subject to Centers for Medicare and Medicaid Services compliance requirements.

• Commissioner may request the Director of the Office of Management and Enterprise Services to transfer monies between this fund and other Department of Health funds as needed.

• Effective date: November 1, 2013.
