SB 620 Summary

• Amends 63 O.S. 2011, Section 2-201 to grant the Director of the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control authority to classify new products and non-controlled substances with potential for abuse as controlled dangerous substances by rule after notice and hearing.

• Requires any rule classifying substances to be submitted to the next regular session of the Legislature and remain in effect unless the Legislature adopts a concurrent resolution disapproving the rule.

• Expands criteria for making recommendations or orders on substance scheduling to include whether the substance has been scheduled under federal law.

• Prevents the Director from controlling substances through this process if they may be lawfully sold over-the-counter without a prescription and excludes distilled spirits, wine, malt beverages, and tobacco from control authority.

• Effective date of November 1, 2013.
