Competitive bids and contracts exceeding $5,000 must include certification that the bidder has not engaged in collusion or efforts to create sole brand/sole source acquisitions improperly

Substitute products that are alike in quality and design or meet required specifications must be considered in sole source bidding and cannot be prohibited

Public construction contract specifications must include at least three equivalent items from more than one manufacturer and supplier, unless matching preexisting materials with Attorney General approval

Sole source bid proposals cannot require vendors to be located within a specific geographical area, though geographic preference may be given when costs are equal or lower

Office of Management and Enterprise Services is authorized to promulgate rules implementing these provisions; declared an emergency measure effective upon passage
