SB 632 Summary

• Requires physicians to notify at least one parent of an unemancipated minor 48 hours before performing an abortion, or notify the guardian/conservator if one has been appointed.

• Notification must be delivered personally or by certified mail with restricted delivery to the parent's usual place of abode.

• Exempts notification requirements if a medical emergency exists where immediate abortion is necessary to prevent death or substantial bodily impairment, though physician must notify parent within 24 hours after the procedure.

• Waives notification if the minor provides notarized written statement confirming parent notification, or if minor reports being a victim of parental sexual or physical abuse to the physician who then notifies child protective authorities.

• Violation of notification requirements constitutes a misdemeanor and grounds for civil action; effective November 1, 2013.
