SB 674 - Summary

• Amends 19 O.S. 2011, Section 298 to modify legibility requirements for documents filed with county clerks for recording.

• Requires handwritten documents to be clearly legible and typewritten documents to use no smaller than 10 point font, in dark xerographically reproducible ink on paper suitable for copying equipment.

• Allows county clerks to accept nonconforming documents that are legible without magnification, xerographically reproducible, meet all other statutory requirements, and include payment of an additional fee.

• Permits digitized images or electronic copies of original documents to satisfy recordation requirements if submitted electronically pursuant to the Uniform Real Property Electronic Recording Act.

• Effective November 1, 2013.
