SB 789 Summary

• Prohibits state agencies, counties, and municipalities from using public or private funds, employees, or resources to alter, mark, or modify low-point beer packaging at retail locations.

• Allows parties aggrieved by violations of the low-point beer packaging restrictions to seek injunctive relief; each party bears their own costs and attorney fees with no damages recoverable.

• Amends Oklahoma Statutes Section 524 to allow wholesalers to sell alcoholic beverages received in single lots at agreed-upon prices without regard to current posted prices, limited to a maximum of four (4) total lots.

• Requires persons coming into possession of alcoholic beverages as security, insurance salvage, or in fiduciary capacity to register with the Director, pay a $10 registration fee, and post a bond before selling to licensed wholesalers.

• Effective date: November 1, 2013.
