SB 886 Summary

• Amends 47 O.S. 2011, Section 955 to expand the roadways from which vehicles may be towed to include public roads, highways, streets, turnpikes, private parking lots accessible to the public, and private roads providing access to single-family or multifamily dwellings.

• Adds a new circumstance (paragraph 8) authorizing towing of vehicles involved in fatal motor vehicle collisions when needed for evidentiary purposes.

• Requires vehicles to not be released after impoundment unless the owner provides proof of valid insurance or an affidavit of nonuse on the roadway, with an exception for insurers or their representatives who have accepted liability.

• Mandates that towing operators release all personal property within towed vehicles to insurers with accepted liability or to owners with proper identification, with no cost during normal business hours and potential after-hours fees.

• Takes effect November 1, 2013.
