SB 89 Summary

• Amends 21 O.S. 2011, Section 1761.1 to increase penalties for dumping trash on public or private property without consent from a misdemeanor with fines of $200-$5,000 to stricter penalties depending on circumstances.

• Increases fines for dumping flaming or glowing substances that may cause fire from $2,000-$5,000 with up to 60 days jail time to $4,000-$10,000 with up to 120 days jail time during a Governor-declared burn ban.

• Raises the maximum state traffic citation amount for littering violations from $200 to $400, with penalties split equally between a reward fund and the sheriff's service fee account.

• Requires courts to order restitution including property cleanup, removal of debris from public property, community service, or a combination thereof as deemed appropriate.

• Becomes effective July 1, 2013, with an emergency declaration allowing the act to take effect immediately upon passage and approval.
