SB 951 Summary

• Amends 12 O.S. 2011, Section 2502 to modify the definition of "representative of the client" under attorney-client privilege laws.

• Expands "representative of the client" to include any person who makes or receives confidential communications while acting in the scope of employment for the client for purposes of effectuating legal representation.

• Clarifies that attorney-client privilege protections extend to communications made by representatives of clients and between representatives of the same client.

• Adds provisions protecting against waiver of attorney-client privilege when inadvertent disclosure occurs, provided reasonable steps were taken to prevent and rectify the error.

• Effective date: November 1, 2013.
