SB 989 - Bogus Checks Definition

• Amends 21 O.S. 2011, Section 1541.4 to expand the definition of "false or bogus checks" to include payment made to a landlord under a lease or rental agreement.

• Adds checks given as down payments for goods, checks in exchange for money or property, and checks in exchange for any benefit or thing of value to the definition of bogus checks.

• Maintains existing provisions that checks dishonored due to insufficient funds or closed/nonexistent accounts constitute prima facie evidence of intent to defraud when not paid within five days of presentation.

• Clarifies that checks offered for purchase of goods or livestock that are refused by a drawee do not constitute an extension of credit to the maker or drawer.

• Effective date: November 1, 2013.
