HB 1067 Summary

• Amends 21 O.S. 2011, Section 748.2 to require peace officers who encounter human trafficking victims to provide written notice of victims' rights and inform them of an emergency hotline number.

• Establishes procedures for law enforcement and Department of Human Services to conduct joint investigations when a child may be a victim of human trafficking or sexual abuse, with the child placed in DHS custody for no longer than 72 hours pending a show-cause hearing.

• Requires dismissal of criminal charges if a show-cause hearing determines by a preponderance of the evidence that a child is a victim of human trafficking or sexual abuse, allowing DHS services to proceed instead.

• Adds presumption in prosecutions of persons aged 16-17 for prostitution offenses that the defendant was coerced into committing the offense through human trafficking in violation of Section 748.

• Effective date: November 1, 2013.
