HB 1097 Summary

• Prohibits operating a motor vehicle on public streets or highways while using a cellular telephone or electronic communication device to compose, send, or read text-based communications while the vehicle is in motion.

• Provides exceptions for emergency communications with emergency response operators, hospitals, physicians' offices, ambulance services, firefighting services, or law enforcement agencies.

• Establishes a fine and court costs not to exceed $500.00 as penalty for violations.

• Authorizes municipalities to enact ordinances with identical provisions and enforcement standards, preventing more stringent local penalties.

• Becomes effective November 1, 2013.
