HB 1241 Summary

• Amends 21 O.S. 2011, Section 1401 to clarify arson in the first degree statutes by removing language that tied the crime to manufacturing controlled dangerous substances.

• Creates two separate subsections: Section A addresses general arson (willfully setting fire to or burning buildings/structures/persons using explosive devices or accelerants), and Section B specifically addresses arson committed while manufacturing controlled dangerous substances.

• Establishes mandatory punishment for arson in the first degree conviction as a fine up to $25,000 and/or imprisonment in the Department of Corrections custody for not more than 35 years.

• For Section B offenses (arson during drug manufacturing), changes penalty to require both a fine not to exceed $25,000 AND imprisonment for not more than 35 years (no alternative option).

• Effective date: November 1, 2013.
