ENR. H. B. NO. 1297 Summary

• Amends 21 O.S. 2011, Section 1123 to modify penalties for lewd or indecent proposals and acts against children under 16 years of age, making it a felony punishable by 3-20 years imprisonment, or 25+ years if the victim is under 12.

• Establishes enhanced penalties for repeat offenders: second or subsequent violations result in ineligibility for probation or suspended sentence; third or subsequent violations carry life or life without parole sentences.

• Provides that persons convicted twice of related sex crimes (Section 1114, Section 888, Section 843.5) plus one violation of this section shall be punished by life or life without parole.

• Repeals 21 O.S. 2011, Section 1123 as amended by Section 6, Chapter 455, O.S.L. 2002 (a duplicate section of law).

• Takes effect November 1, 2013.
