ENGR. H. B. NO. 1304 Summary

• Amends 22 O.S. 2011, Section 1161 regarding criminal procedure for persons found not guilty by reason of insanity.

• Establishes procedures for court examination and evaluation of insane persons, including psychiatric evaluations within 35-45 days to determine if the person is presently dangerous or requires treatment.

• Creates a seven-member Forensic Review Board to review confined individuals and make recommendations regarding therapeutic visits, conditional release, and discharge.

• Specifies conditions for conditional release, including required outpatient treatment plans, annual compliance reports, and authority to revoke release for violations or noncompliance.

• Takes effect November 1, 2013.
