HB1428 Summary

• Requires operators of commercial injection or disposal wells and land application sites to collect an additional 15% fee on deleterious substances (such as oil field brine, waste oil, and mud) that originated in another state.

• The additional fee is calculated by adding 15% to the fee charged for similar in-state deleterious substances, or if no in-state substances are disposed of at the site, by adding 15% to the previous out-of-state fee.

• Fees must be paid quarterly to the Oklahoma Corporation Commission within one month after each quarter ends.

• The Corporation Commission distributes collected fees to county commissioners and the Department of Transportation (for road repair and construction), and may retain up to 5% for administration.

• The act becomes effective July 1, 2013, and is declared an emergency.
