HB1487 Summary

• Prohibits state agencies, government units, state employees, and members of the Military Department of Oklahoma (Army and Air National Guard) from knowingly assisting federal armed forces in detaining Oklahoma citizens under 50 U.S.C. Section 1541 (National Defense Authorization Act for Fiscal Year 2012, Section 1021)

• Applies only when assistance would place state entities, employees, or National Guard members in violation of the U.S. Constitution, Oklahoma Constitution, Oklahoma Statutes, legislative acts, or Oklahoma Administrative Code rules/regulations

• Exempts participation by state and local law enforcement, Military Department, and National Guard in joint task forces and partnerships with federal law enforcement, as long as the cooperation is not for purposes of participating in such detentions

• Creates new Section 3120 of Title 74 of the Oklahoma Statutes

• Effective date: November 1, 2013
