HB 1548 Summary

• Restricts the use of "incompatibility" as a ground for divorce if there are minor children, the marriage lasted 10+ years, or either party objects in writing.

• Requires both parties to pay their own expenses (including attorney fees) unless one spouse caused the dissolution by committing a fault-based ground for divorce listed in Section 101.

• If one spouse caused the dissolution through fault, the court shall order that spouse to pay the other party's expenses including attorney fees.

• Implements unequal property division where the at-fault spouse receives only one-quarter (1/4) of marital property while the other spouse retains three-quarters (3/4) of marital property.

• Takes effect November 1, 2013.
