HB 1672 Summary

• Health benefit plans that provide prescription drug coverage must notify enrollees in writing or electronically of any deletions from the prescription drug formulary at least 60 days prior to the deletion.

• Notification requirement applies only to deletions other than generic substitutions for drugs the enrollee is currently taking.

• Exception excludes drugs subject to new safety warnings or Federal Drug Administration safety recalls as determined by the health benefit plan's therapeutics committee.

• Defines "health benefit plan" by reference to existing Oklahoma Statutes Section 6060.4(C).

• Effective date: November 1, 2013.
