HB 1763 Summary

• Amends 44 O.S. 2011, Section 21.1 to change Military Department state employees from unclassified to classified service status.

• Employees in classified service remain subject to Oklahoma Personnel Act provisions regarding appointments, promotions, adverse actions, and all personnel matters.

• Authorizes the Adjutant General to establish National Guard membership as a special requirement for certain positions requiring military training, command authority, or direct administration of National Guard functions and facilities.

• Employees separated from the National Guard or who do not hold the specified military grade for their position will be reclassified, promoted, demoted, transferred, or separated per Oklahoma Personnel Act and Merit Rules for Employment.

• Effective date: November 1, 2013.
