HB 1792 Summary

• Creates the Oklahoma Temporary Motorist Liability Plan to provide minimum vehicle liability insurance coverage when law enforcement seizes a license plate for failure to maintain insurance under the Compulsory Insurance Law.

• Coverage is provided from when a citation is issued and the license plate is seized until the vehicle owner obtains proper insurance, retrieves the license plate, or the ten-day temporary citation expires.

• Establishes the Temporary Insurance Premium Pool funded by administrative fees ($125 total) distributed to the county sheriff ($20), law enforcement agency ($70), Plan Administrator ($10), and the Pool ($25).

• Requires the Insurance Commissioner to develop policy forms and the Office of Management and Enterprise Services to select an insurer through competitive bidding with bids due November 1 annually.

• Designates a statewide association of county sheriffs as Plan Administrator and makes Plan coverage secondary to any other insurance in effect on the vehicle.
