HB 2342 Summary

• Amends Oklahoma criminal procedure law (22 O.S. 2011, Sections 1221, 1225, and 1231) relating to search warrants and seizures.

• Adds definition of "personal property" to mean items and information that can be analyzed, seen, weighed, measured, felt, touched, or perceived by the senses.

• Establishes procedures for obtaining search warrants by telephone or electronic mail, including audio-recording and transcribing telephonic warrant applications.

• Permits magistrates to issue warrants via electronic communication by physically signing and transmitting documents back to the affiant, or by authorizing issuance of submitted or modified warrants.

• Provides exception to execution and return requirements for search warrants authorizing forensic, scientific, or digital analysis of items already in law enforcement custody; search must commence within reasonable time with return within 10 days of completion.

• Effective date: November 1, 2014.
