HB 2343 Summary

• Amends Oklahoma Evidence Code (12 O.S. 2011, Section 2804) to add a new hearsay exception allowing statements against a party who wrongfully caused or acquiesced in making the declarant unavailable as a witness, if done with intent to produce that result

• Expands hearsay exceptions to include statements made by unavailable witnesses when the opposing party bears responsibility for their unavailability through wrongful conduct

• Maintains existing hearsay exceptions for prior testimony, dying declarations, statements against interest, and family history statements

• Effective date: November 1, 2014
