HB 2402 Summary

• Allows the Oklahoma Health Care Authority to file and enforce liens against a nursing home patient's homestead if the patient has declared intent not to return home or cannot reasonably be expected to return home after one year of care.

• Modifies lien requirements by removing the requirement that the lien amount begins after one year, instead allowing liens to cover all assistance paid from the time of filing onward.

• Permits recipients to discharge liens by paying either the full lien amount or the fair market value of the homestead, whichever is applicable.

• Allows up to $6,000 from homestead sale proceeds to be placed in an irrevocable trust with the Authority as remainder beneficiary, with funds designated for the recipient's funeral expenses.

• Effective November 1, 2014.
