HB2410 Summary

• Allows persons with nonviolent felony drug convictions to request modification of their convictions by the court that imposed the original sentence

• Eligibility requirements include: conviction under Uniform Controlled Dangerous Substances Act (but not Trafficking in Illegal Drugs Act), no other misdemeanor or felony convictions, no pending charges, and at least 5 years have passed since sentence completion

• Courts may amend eligible felony convictions down to misdemeanors if satisfied that public safety will not be jeopardized

• Requires open court hearings with advance notice (at least 21 days) to defendant, defense counsel, and district attorney of the county where conviction occurred

• Becomes effective November 1, 2014
