HB 2461 Summary

• Chief law enforcement officers must provide firearm certification within 15 days when required by federal law, if the applicant is not prohibited from receiving the firearm.

• If certification is denied, the chief law enforcement officer must provide written notification stating the reasons for denial.

• Applicants whose certification requests are denied may appeal to district court, which will review the decision de novo.

• If the court finds the applicant is not prohibited from receiving the firearm, it must order the certification issued and award court costs and reasonable attorney fees to the applicant.

• The act becomes effective November 1, 2014.
