HB 2609 Summary

• Amends 22 O.S. 2011, Section 18 to modify qualifications for filing expungement motions to seal criminal records in Oklahoma.

• Reduces the waiting period for misdemeanor expungement from two (2) years to one (1) year after dismissal following successful completion of deferred judgment or delayed sentence.

• Provides that offenses arising out of the same transaction or occurrence shall be treated as one conviction and offense for purposes of seeking expungement under specified paragraphs.

• Allows Pardon and Parole Board records related to pardon applications to be sealed to the public (but not to the Board) when expunging records under paragraphs 4, 6, or 11.

• Became effective November 1, 2014.
