HB 2638 Summary

• Requires persons accused of felony offenses specified in Title 21 Section 13.1 or Title 57 Section 571 to submit DNA samples after finding of probable cause or valid felony arrest warrant for the OSBI CODIS Database.

• Establishes procedures for DNA sample collection by peace officers, county sheriffs, or their employees/contractors, with samples mailed to OSBI within 10 days and a $15.00 fee charged to the subject.

• Expands the OSBI Combined DNA Index System (CODIS) Database to include DNA profiles from accused felony offenders (in addition to existing categories of convicted offenders and sex offender registrants).

• Provides immunity from civil liability for persons collecting DNA samples and requires use of OSBI-provided sample kits and procedures.

• Takes effect November 1, 2014.
