HB2705 Summary

• Amends the Telemarketer Restriction Act (15 O.S. 2011, Sections 775B.2 and 775B.6) to strengthen consumer protections against telemarketing calls and text messages.

• Deletes the definition of "established business relationship" from the law, removing the exemption that previously allowed telemarketers to call consumers with whom they had a prior or existing business relationship.

• Expands the definition of "telemarketing" to explicitly include cellular telephone text messages and clarifies that the law applies to any unsolicited call or message for commercial purposes.

• Maintains the 30-day waiting period requirement after a consumer's telephone number appears on the Oklahoma Do Not Call registry before telemarketers can contact them.

• Becomes effective November 1, 2014.
