HB 2804 Summary

• Amends 57 O.S. 2011, Section 37 regarding the Department of Corrections' management of inmates housed in county jails while awaiting transfer to state facilities.

• Requires the Department to receive inmates within 45 days of receiving the judgment and sentence, unless other arrangements are made with the sheriff; if a county jail reaches capacity, the Department must receive the inmate within 72 hours of notification.

• The Department becomes financially responsible for housing costs at the per diem rate specified in Section 38 from the date of sentencing until the inmate's transfer, including costs for inmates with pending charges in other jurisdictions.

• Establishes jail reimbursement rates with a minimum of $27.00 per day effective January 1, 2007, and allows counties without existing contracts to negotiate rates with the Department; if negotiations fail within 45 days, a district judge determines the rate.

• Effective date: January 1, 2015.
