ENGR. H. B. NO. 2807 - Oklahoma Community Protection Act

• Creates the "Oklahoma Community Protection Act" to prohibit state and political subdivisions from adopting policies that restrict private property rights without due process (notice, public hearings, and voter approval).

• Defines "political subdivision" as any county, city, town, municipality, district, or other public entity of the state.

• Declares any attempt to restrict private property rights without due process as null and void under both Oklahoma and U.S. Constitutions, with an exception allowing property acquisition through the eminent domain process.

• Provides that property owners whose constitutional rights are violated may receive damages of at least 10 times the property's previous assessed value plus treble (triple) attorney fees.

• Becomes effective November 1, 2014.
