HB 2999 Summary

• Amends 75 O.S. 2011, Section 309 to restrict executive sessions to only agency members rendering final decisions, prohibiting participation by employees, contractors, or attorneys except counsel advising on proposed conclusions of law.

• Modifies record requirements to include all evidence and communications received during proceedings on the record after notice to parties, with opportunity for parties to respond and contest all evidence presented.

• Prohibits all communication, data, or evidence exchanges after the evidentiary record closes; requires immediate disclosure if any communication is received, with reopening of hearing for parties to address the disclosed information.

• Mandates disqualification and withdrawal of hearing examiners or agency members who solicit or knowingly receive undisclosed communications, data, or evidence without prompt disclosure to all parties.

• Requires all communications and evidence be maintained and provided in compliance with the Oklahoma Open Records Act; establishes effective date of November 1, 2014.
