ENR. H.B. 3160 Summary

• Amends the Oklahoma Scrap Metal Dealers Act by clarifying that a person must not advertise, act, offer to act, hold themselves out, or engage in business as a scrap metal dealer without a license from the Oklahoma Department of Agriculture, Food, and Forestry.

• Authorizes the Department to assess administrative penalties between $100 and $10,000 for each violation of the Act, with each action or each day a violation continues constituting a separate violation.

• Grants the Department authority to seek temporary or permanent injunctions and civil monetary penalties against violators, and allows the Department to subsequently pursue maximum civil or criminal penalties in court after administrative proceedings.

• Permits persons assessed penalties to be required to pay attorney fees and costs associated with collection, and authorizes the Department to obtain administrative warrants to enforce access and inspection rights.

• Allows the Department to tag weights and measures used by unlicensed scrap metal dealers as "Not For Commercial Use"; bill becomes effective November 1, 2014.
