HB 3250 Summary

• Amends Oklahoma law to allow municipalities, counties, or neighboring property owners to file lawsuits against unit owners or real estate developers who fail to maintain drainage common elements, stormwater retention/detention areas, or similar drainage features.

• Authorizes courts to award damages, injunctive relief, abatement, or other remedies; prevailing parties receive reasonable attorney fees as costs.

• Permits municipalities and counties to enter drainage common areas and perform necessary maintenance after 30 days' notice to owners, with costs levied against all property owners on a pro-rata basis.

• Provides exception: no levy shall be filed against owners who provide evidence of current dues payment to the council of unit owners or owners association.

• Effective date: November 1, 2014.
