HB 3295 Summary

• Changes law enforcement responsibility for transporting persons to mental health facilities from mandatory ("shall") to permissive ("may")

• Applies to sheriffs, peace officers, and municipal law enforcement agencies transporting individuals for mental health examination, emergency detention, protective custody, and inpatient services

• Maintains law enforcement responsibility for transportation while the individual is receiving services at the designated facility

• Requires the Department of Mental Health and Substance Abuse Services to reimburse law enforcement for transportation costs and allows reimbursement under the State Travel Reimbursement Act

• Effective date: November 1, 2014
