HB 3349 Summary

• Creates the "Environmental Remediation Revolving Fund" in the State Treasury for the Secretary of Energy and Environment, funded by Natural Resource Damage Assessments received on behalf of the state pursuant to Title 27A Section 1-2-101.

• Establishes the "Environmental Programs Revolving Fund" in the State Treasury for the Secretary of Energy and Environment, funded by appropriations, fees, charges, penalties, and other sources not designated for other funds.

• Both revolving funds are continuing funds not subject to fiscal year limitations, with all accrued monies automatically appropriated and available for budgeting and expenditure by the Secretary to perform duties imposed by law.

• Expenditures from both funds require warrants issued by the State Treasurer against claims filed with the Director of the Office of Management and Enterprise Services for approval and payment.

• Effective date is July 1, 2014, with an emergency declaration allowing the act to take effect immediately upon passage and approval.
