HB 3401 Summary

• Prohibits school counselors, therapists, social workers, administrators, teachers, and other school personnel from referring students under 18 years old to outside individuals or organizations without parental notification

• Prohibits providing contact information, business cards, brochures, or other materials from external entities to students under 18 without parental consent

• Requires notification of parents or legal guardians within 24 hours via email, phone call, or text message if a referral or information sharing occurs

• Becomes effective July 1, 2014

• Declared an emergency measure
