SB 1 Summary

• Amends 37 O.S. 2011, Section 8 to add an exception for persons who request emergency medical assistance for someone appearing to need medical help due to alcohol consumption.

• Peace officers cannot take a person into custody solely for an alcohol-related offense if the officer determines the person requested emergency medical assistance and met specified conditions.

• Provides immunity from criminal prosecution under Section 8 of Title 37 for persons meeting the criteria, if the offense involved intoxication caused by alcohol use.

• Requires the person seeking immunity to have provided their name and information, remained at the scene until emergency medical assistance arrived, and cooperated with emergency personnel and law enforcement.

• Prohibits persons from initiating or maintaining civil actions against peace officers or their employing political subdivisions based on the officer's compliance or non-compliance with these provisions.

• Effective date: November 1, 2013.
