SB 1187 Summary

• Department of Environmental Quality shall receive, review, and evaluate permit applications for discharges to water bodies related to water reuse projects and approve applications that comply with applicable rules.

• Department shall issue permits for point-source discharges into sensitive public and private water supplies where discharge pollutant concentrations do not exceed existing concentrations in the receiving water body.

• Issuance of such permits shall not be considered a violation of the state's anti-degradation water quality standards provisions.

• Upon receipt of a water reuse project discharge permit application, DEQ must acknowledge the application date in writing or by email and review it according to timelines adopted by the Environmental Quality Board.

• Applications for point-source discharges into waters designated as Sensitive Public or Private Water Supplies are classified as Tier III permit applications under the Uniform Environmental Permitting Act; emergency clause declares act effective immediately upon passage and approval.
