SB 1189 Summary

• Makes it illegal to operate a motor vehicle while composing, sending, or reading electronic text messages on a cellular telephone or communication device while the vehicle is in motion.

• Establishes a minimum fine of $100 for violations of the texting while driving prohibition.

• Provides exemptions for using communication devices to contact emergency services, hospitals, physicians, ambulance providers, firefighting services, or law enforcement regarding imminent emergencies.

• Authorizes municipalities to enact and enforce local ordinances with identical or less stringent penalties for the same conduct.

• Effective date: November 1, 2014.
