SB 1218 Summary

• Amends 63 O.S. 2011, Section 1-1709.1 to define and protect peer review information as private, confidential, and privileged in Oklahoma healthcare settings.

• Expands definition of "health care entity" to include hospitals, ambulatory surgical centers, state medical school clinical practices, and any other entity directly involved in healthcare delivery that engages in credentialing or peer review processes.

• Permits healthcare entities and county medical societies to provide relevant peer review information to state licensing agencies and boards with notice to the affected healthcare professional.

• Prohibits peer review information and factual statements from discovery in civil negligence actions, except credentialing data and peer review recommendations become discoverable in corporate negligence claims against healthcare entities.

• Prevents persons involved in peer review processes from being required to testify or disclose peer review information in civil proceedings.

• Effective date: November 1, 2014.
