S.B. No. 1371 Summary

• Amends unlawful proceeds law to define "specified unlawful activity" as any act punishable as a misdemeanor or felony under Oklahoma law, or that would be punishable in the state where it occurred and under Oklahoma law

• Establishes tiered criminal penalties based on amount involved: misdemeanor for $2,500 or less; felony with up to 2 years imprisonment for over $2,500 but not more than $10,000; felony with 2-10 years for over $10,000 but not more than $50,000; and felony with 5-20 years for over $50,000

• Adds civil penalty of three times the value of property involved in violation, split evenly between prosecuting agency and investigating law enforcement agency

• Authorizes district attorney or Attorney General to bring forfeiture actions and requires such action within 90 days of seizure or property must be returned to owner

• Changes evidence standard for forfeiture proceedings from "clear and convincing" to "preponderance of the evidence" and designates proceedings as special proceedings
