SB 1432 Summary

• Amends child support laws to make both mothers and fathers liable for supporting children born out of wedlock, with liability determined through acknowledgment or judicial/administrative order rather than paternity alone.

• Reduces the lookback period for retroactive child support liability from five (5) years to two (2) years prior to filing an action for establishment of paternity.

• Expands parental support obligations to include medical support (health insurance, cash medical support, or combination) and requires both parents to share proportionate costs of unreimbursed medical expenses.

• Establishes procedures for the Department of Human Services to issue notices of paternity and support obligations, with genetic testing to determine biological paternity when disputed, and allows challenging acknowledgments of paternity within 60 days or before administrative proceedings commence.

• Effective date: November 1, 2014.
